This includes, without limitation, damages or losses suffered due to negligence.

Your Personal Information
When you make purchases from our Site, you may checkout as a guest, but at the end of your purchase you will be prompted to create a personal account.
To interact with our Site (ie: review, rate or comment on a product or create a wish list) you must also create a personal account.
When you set up an account with Vitawell.ca, you’re required to provide Vitawell with correct personal information. Providing false details or another person’s details as your own is not acceptable. Providing false information is considered a violation to our Site’s Terms and Conditions.

When your personal information is collected by Vitawell.ca, it will not be disclosed to any third party unrelated to Vitawell.ca, unless required or authorized by law, or if you’ve personally given consent to such a disclosure. Otherwise, Vitawell commits to its Privacy Policy.

Orders, Payments and Credit Card Information
When collected for the purpose of payment for merchandise at Vitawell.ca, your credit card information is stored securely using a PCI DSS compliant solution. Your credit card will be charged upon entering information for your purchase (such as billing, shipping and credit card information), not when the item is shipped.

The credit card information stored in your account will not be visible to Vitawell Customer Service Representatives. Providing your credit card information to Vitawell.ca as payment for the product(s) states that you agree to your purchase of the selected product(s).

You may not pay, or attempt to pay for the products on our Site with a fraudulent credit card or false information.

In some cases, we may not be able to verify international or foreign credit cards, and Vitawell.ca reserves the right to decline, cancel or refund orders placed with international cards without notice.

Account Security
You are required to provide a password upon creating a personal account with Vitawell.ca. You acknowledge that it is your responsibility to maintain the security of your password.
Your password allows you authorized access and use of our Site, pertaining to these Terms & Conditions. This means that you are responsible for any products purchased with your personal account information. It is your responsibility to notify Vitawell immediately if you believe someone has access to your password and personal account.

Site Engagement
You may post comments and reviews on our Site, and interact with our Site content, such as blog posts. All content posted by you must not be defamatory, threatening, obscene or illegal. It must not infringe on intellectual property rights or invade the privacy of our Site. The content must not be objectionable to third parties, and is not permitted to consist of, or contain software or malware viruses, or “spam” which refers to mass emailing and commercial solicitation. Vitawell.ca reserves the right to remove such content at any time, without notice.

The content posted by you (unless otherwise indicated) becomes nonexclusive, royalty-free property of Vitawell.ca. Vitawell reserves the right to reproduce, use, modify, adapt, publish, display and distribute such content on its Site, social media channels and any alternative marketing materials that Vitawell.ca may create.

Taxes and Merchandise Pricing
The prices displayed on Vitawell.ca are listed in Canadian dollars. The GST, PST or HST that applies to your province will be shown and applied at checkout, and do not include the cost of delivery.

Delivery charges will be added on top of the cost of merchandise and applicable taxes. Government sales tax and provincial sales tax are subject to change without notification to users of the Vitawell.ca website.

All prices are subject to change. The prices displayed on our Site are only valid online at the time they are displayed.

All Canadian orders over $99.00 on Vitawell.ca are eligible for free expedited (1-5 day) shipping. All U.S. orders over $150.00 are eligible for free expedited (10-14 day) shipping. Your order is also subject to our 30 day return policy for all unopened and opened items, with the exception of sexual wellness products and clearance merchandise. If your order is over $75.00, a 15% restocking fee may apply.

Errors
Vitawell may correct errors which appear on the Site, or refuse any orders that have been received in association with such errors. In addition, Vitawell.ca reserves the right to reject or cancel orders placed at any time.

Vitawell.ca’s right to refuse or cancel orders at any time will be in effect whether or not the order has been charged to your credit card or confirmed. In the event that you credit card has been charged for your order, and your order is cancelled by Vitawell.ca, Vitawell will immediately issue a credit to your card in the full amount of the charge.

Order Confirmation and Acceptance
You authorize that all information you provide to Vitawell.ca at the time of placing an order for all merchandise for sale on our Site, and in relation to an order made using our Site, is genuine and correct.

Receiving a receipt of your order with confirmation from Vitawell does not indicate the acceptance of your order, and it does not confirm our offer to sell. Vitawell.ca reserves the right to decline or accept your order at any time, even after the receipt of your order. All orders placed must be pre-approved with an acceptable payment method of Vitawell.ca.

Vitawell may require additional information or verification before any order is accepted.
We reserve the right to refuse any order without offering reason. If we cancel an order, we will make appropriate attempts to contact you using the details you’ve provided us. All received payments will be refunded using the method of payment received.

Communication
We will communicate with you about your order and the purchased product via phone or email. Account holders are asked to provide a valid email address to Vitawell for this reason.

On occasion, Vitawell may also send you marketing materials, such as Newsletters, promotions or other special offers on our Site. If you do not wish to receive any additional material from us, you may unsubscribe from our mailing list at any time by editing your account settings, or by clicking on the “unsubscribe” button at the bottom of our emails.

Product Availability
At times, our best-selling brands can experience a higher than usual inventory turnover. Our best efforts are taken to reduce the occurrence of an item becoming unavailable, however, we cannot guarantee that an item will not become unavailable after it has been purchased by a customer at the time you have placed an order for the same item. In this event, Vitawell reserves the right to cancel and refund the order, unless an appropriate replacement can be provided and agreed to by the customer.

Cancellations
If you wish to cancel your entire order, or parts of your order and it has not yet been fulfilled by Vitawell.ca, you will not be charged for the items that have been cancelled, and you will not be subject to a cancellation fee. If you wish to cancel the order at the time it has already been fulfilled, we are unable to provide a cancellation and you will be required to initiate a return upon receiving the order instead.

Vitawell.ca also reserves the right to cancel your order if you’ve provided fraudulent credit card information, or an unauthorised credit card, if your method of payment is declined, if you’ve provided false personal information or if the product you’ve ordered is no longer available. Vitawell.ca agrees to notify you upon the cancellation of your order.

Termination of Use, Consequence of Termination and Suspension of Use
If you violate the terms and conditions of Vitawell.ca, we reserve the right to terminate or suspend the use of your account at anytime without notice. In the event that your account is terminated or suspended, you will be unable to access Vitawell.ca.
If you are terminated or suspended while awaiting the delivery of your order, Vitawell reserves the right to cancel your order. Upon cancellation, a refund may be issued to the credit card or payment method used during the purchase of the order.

Delivery of Order
Vitawell.ca delivers to Canada and The U.S. typically within 3-15 working days. Upon delivery, the courier may request a signature.

If you’re not present at the shipping address provided by you when the courier attempts to deliver your order, your merchandise may be left at the front door of the address provided if the driver deems it to be safe. Your order may otherwise be left at the nearest courier depot for pick up. The courier will notify you of the whereabouts of your order with a slip on your door or in your mailbox. In the event that you are unreachable for the delivery of your product, your order will be returned to Vitawell. To receive your order, our Customer Service Team will attempt to make contact and execute an alternative delivery.
